Welcome to Elegnano's online store. This website includes a webshop for e-commerce. Through this medium we sell online shoes under the brand ‘Elegnano’. The products and website belong to Elegnano BV. The official registered offices of Elegnano are at Olivierstraat 21, 3111 Wezemaal, Belgium, with VAT registration number BE 0566.976.183. We can be reached at info@elegnano.com.

In the terms and conditions on this webpage, the user of the website, who wishes to buy Elegnano products, is often referred to as ‘the customer’. The terms and conditions described here govern all use of www.elegnano.com, including the products, reductions and sales on this website. The visitor of this website and the customer that buys a product on it, agrees to be bound to these terms and conditions. Be aware that Elegnano updates the terms and conditions from time to time. Therefore we recommend the customer to read them carefully each time she/he visits and/or uses our website. Other terms and conditions are not accepted by Elegnano BV, unless we have a different agreement in writing with you.

Product information

At Elegnano we do our very best to provide you with accurate information and images of our products. Every product is provided with a description (color, size, materials etc) and digital photographs at different angles. It is however possible, that the quality of the images and colors perceived may vary depending on the screen that is used by the customer. Therefor we cannot guarantee that what you see on your screen while visiting our website perfectly reflects all the characteristics of the real product.

Ordering

To order a product from the Elegnano website, the customer has to select the product, and specify color and size she/he wants to purchase. By clicking on ‘Add to shopping bag’, the chosen article is added to the shopping bag. At this point, the customer can still alter the articles in the ‘shopping bag’ or remove them. Please note that, since Elegnano does not work with an account, all items and information entered in the ‘shopping bag’ are lost when the user closes the web browser. If the customer wishes to go through with the purchase of the selected items in the ‘shopping bag’ and confirm the order, she/he should select the delivery and payment method of preference. The customer has to provide an address for delivery, please include all information correctly to make sure the order arrives at the correct address.

In the next steps safe payment is guaranteed and explained explicitly by the internet payment partners of Elegnano. After submission of the order, the customer is redirected to a secure payment page on the Elegnano website where the payment is conducted. Upon successful payment, a confirmation will appear on the screen of the customer. She/he will also receive a confirmation of the order and payment via (the provided) e-mail.

The total amount due is always shown clearly throughout the billing process and payment procedure. Once the payment process is completed, the order is final and can no longer be changed. If you made a mistake, please contact our customer service immediately at sales@elegnano.com.

If you wish to pay  through bank transfer, we are happy to offer you that service. Please send an e-mail to sales@elegnano.com with details of the item you wish to purchase (name, color and size), and we will provide you with the necessary information to make the payment via bank transfer.

After ordering the customer will receive an e-mail with the confirmation of the order. A second e-mail will be received by the customer when the order is send. Please take into account, as soon as your order is transmitted to us, we are no longer able to change the delivery address.

In the unlikely event that your order is no longer available, our customer service will contact you immediately. You can opt for a later delivery, change the order or get a full and immediate refund.

If it is indicated on the webshop that a product is out of stock, please send an e-mail to sales@elegnano.com with name of the wished item and size. We will send you an email as soon as the product is back in stock.

The data registered at Elegnano BV’s IT systems, including its hosting and internet payment partners, is the only rightful evidence of the provided customer information, the content of the orders and all transactions between Elegnano BV and its partners on one side and the customer on the other side, whatever different information or evidence the customer may have (in writing).

Products remain property of Elegnano BVBA until the customer has paid for the products in full.

If the customer validates an order form, this is considered equivalent to an electronic signature. This holds the same value between the customer and Elegnano BV as a written signature, therefore serving as evidence of completion of the order. In that case, the order will be carried out and the amount due may be claimed.

Pre-ordering

Pre-ordering means that the products are not available yet, but from the moment it is in stock, will be delivered to the address the customer provided. Pre-ordering in only available on a selection of products.

Pre-orders need to be paid in advance through a proposed payment method offered on the webshop. You will receive a confirmation via e-mail after pre-ordering and get a notification when your order is shipped. Pre-ordering procedures are very similar to the ordering procedure described above.

If you wish to pay  through bank transfer, we are happy to offer you that service. Please send an e-mail to sales@elegnano.com with details of the item you wish to purchase (name, color and size), and we will provide you with the necessary information to make the payment via bank transfer.

Prices and Payment

All prices are in Euro and inclusive of VAT for Belgium and other countries in Europe. For countries out of Europe, VAT is excluded. For international orders, please contact our sales office at sales@elegnano.com to get more specific information on delivery costs.

Prices may change (p.e. sales). The applicable price to the order of a customer is the price advertised on the website at the time the order was placed.

You can pay via the offered paying methods on the webshop or through bank transfer.

Please be aware that depending on your card issuer, especially for international transactions, there can be extra charge. There are no extra fees for payments via Bancontact/Mistercash, Maestro, Credit Card or advance payments.

By ordering in the webshop of Elegnano, the customer agrees to Elegnano BV to send the invoice of the order electronically.

Disputes

This agreement is governed by the Belgian law. The customer and user of the website and webshop accepts the jurisdiction of the Leuven Courts. If a provision of these terms and conditions is invalid, the validity of the remaining provisions shall remain unaffected.

If you wish to return an item, please follow the three steps described below. It will help us to process your refund as smoothly as possible.

SHIPMENT AND DELILVERY

At Elegnano we try to prepare your order within one working day after placement and payment is completed.

Elegnano delivers all over the world. Deliveries to an address in Belgium take 2 to 3 working days. Only standard delivery is offered. International deliveries take 5 to 6 working days, depending on the country. Standard deliveries on Belgian holidays will take an extra working day. Delivery of orders in Belgium is free of charge. The costs of international delivery depend on the country and the ordered amount. The customer must pay the delivery costs, when applicable, in addition to the purchase price. Delays in delivery of the order, can never be raised to obtain any compensation.

Please, check the goods immediately after delivery.

If your order is delivered damaged, please notify the Elegnano customer service as quickly as possible by sending an e-mail to sales@elegnano.com or by phone +1 510 778 6537. This should be reported within 48 hours after delivery.

 

RETURN POLICY

1. Please send a registered letter with your complaint, wishing to return an item to Elegnano BV, Olivierstraat 21, 3111 Wezemaal, Belgium or an e-mail to sales@elegnano.com, so we can confirm the receipt of your complaint and request to return and provide you with instructions on how to return the items.

2. We will send you a confirmation and notify you of the receipt and processing of the returned items. Return costs may be at the expense of the customer.

3. We will refund the purchased amount within 5 working days. If you wish a voucher or exchange for another product on the webshop instead, we will gladly help you with this.

In agreement with the Belgian Act of 6 April 2010 on market practices and consumer protection, in particular distance selling, returns of Elegnano products are accepted within 14 days, starting from the day of receipt of the package. Only information of the official delivery agent (BPost or UPS) is considered correct in this case. Written complaints do not count as return, meaning the receipt of goods that the customer wishes to return at Elegnano BV has to be fulfilled 14 days after delivery. Returns or exchanges will not be accepted later than 14 days after delivery to the customer. The return address is: Elegnano BV, Olivierstraat 21, 3111 Wezemaal, Belgium.

You do not have to specify a reason for returning an item, but we are always open to hear suggestions or complaints (e-mail: sales@elegnano.com).

Please note the following remarks.

Items must be returned in the original state: New, unmarked, unused, in the original Elegnano-box, with all accessories and packaging material (silk paper, authenticity cards, care-bags). Returned goods that are damaged, or have any sign of use or wear will not be accepted and your refund will be withheld. Shoes should be tried on a carpeted, clean and soft surface. Also store them in the accompanying dust bags until you are certain you will keep them. Any dirt on the inside, outside or soles is considered damage.

The returned goods are the responsibility of the customer until they arrive back at Elegnano. All returned items should be appropriately and sufficiently franked, and also have a clear label with the customer address. Packages that are not sufficiently franked will not be accepted and are immediately returned to sender. In that case the shipping costs are borne by the sender, being the customer. Keep your proof of postage certificate, as we cannot be responsible for goods lost or damaged in transit.

Once the returned item is received at Elegnano and checked on damage, we will refund your money within 5 working days. The reimbursed money is transferred to the credit card or bank account of the person who paid for the order. Please note that refunds may take up to 10 working days to appear in your account depending on your card issuer. In case you prefer to exchange your returned item for another item of the same price in stock, or you want to receive the equivalent amount in Euros credited by us in the form of a voucher issued by Elegnano for later purchases in our webshop, we are happy to help you with this. Please contact sales@elegnano.com. Note that delivery in Belgium may not be free of charge in case of exchange. Also be aware that in case of a refund, Elegnano is not responsible for fluctuations in the currency rate between the time of initial payment and the moment the refund is made.

If returning an incorrect or faulty item, please follow the same procedure as with regular returns, but mention the fact that the item is incorrect or faulty according to you when you contact our customer service at sales@elegnano.com. An item is deemed faulty if there is a manufacturing fault. We do not consider wear and tear to be a fault. All items that are returned as faulty are thoroughly inspected by the quality control experts of Elegnano to deem whether the product is faulty or whether it is fair wear and tear. We may be able to offer to repair the item, but we cannot guarantee this. Any items that show alterations or have been repaired by an external repair service will not be accepted for refund or exchange.

Please note that sales and gift vouchers cannot be exchanged or returned. Sales and reductions are only valid on the products that mention this explicitly.

PRIVACY POLICY

By using the Elegnano website and webshop, the user agrees to accept the provisions of this privacy policy. Whenever you provide information to us via this website or the webshop, you agree that the information is gathered and used subject to this privacy policy.

Personal data that the customer provided and is obtained via this website, is processed by Elegnano BVBA, Olivierstraat 21, 3111 Wezemaal, Belgium.

Elegnano will only use this data to manage the service, after-sales service and to send you information. You can always review your data, correct it and refuse to allow us to use your data to send you information. This can be done by sending a request in writing to the address above or an e-mail to info@elegnano.com.
